Terms of Use

I am applying for membership in Bikestation, operated by Mobis Transportation Alternatives, Inc. d/b/a Bikestation ("Operator"). I recognize that if the Operator accepts my application, the application and this agreement will become a binding contract (the "Contract"), and that the Operator's acceptance of my application and subsequent activation of membership are subject to my payment of any applicable initiation fees, and that my eligibility for the program is subject to verification of my credit card and legal driver's license, if applicable. By my checking the box in the "I agree to the terms in the waiver agreement", it shall evidence its acceptance of my application, and the Contract shall become effective as of such date.

Fees

I recognize that I will be responsible for paying various fees, per the pricing on this website, including damages and insurance deductible (in case of accidents), expenses, liens, and fines arising out of my use of the Operator's equipment; and that if the Operator satisfies such obligations owed by me, I agree that this money will be a debt due and payable to the Operator and that I will adhere to the prescribed time schedule for payment.

Waiver/Indemnification

I, for myself, release the Operator, their agents, directors, officers, agents, and employees from any liability for the damage or injury to myself or any person or property resulting from negligence, adjustment, selection and use of this equipment and/or the storing my personal possessions at the Bikestation facility. I understand the inherent risk involved in using this equipment, accept the full responsibility for any and all such damage or injury that may result.

I accept the equipment for use, as is, and in good condition and accept full responsibility for care of equipment while in my possession. I will be responsible for costs up to the retail price for equipment not returned or damaged, other than for reasonable wear and tear, which results from the use of the equipment.

I agree to return rental equipment in clean condition to avoid additional charges. All instruction on the use of rental equipment has been made clear to me and I understand the function of the equipment. I accept the terms of this agreement and accept responsibility for the below charges.

If any provision of this Contract is not enforceable, then the unenforceable provision will be considered deleted from the Contract and the remaining provisions of the Contract will continue to be in effect. Our mutual agreements set forth in this Contract are instead of a warranty, whether expressed or implied.

Termination of Agreement

Either party may terminate this agreement at any time, with or without cause, and without advance notice to either party. If the Operator terminates my membership, I will be notified in writing at the address then shown on the Operator's records. If and at the time I terminate my membership, I will be liable for all pending charges, including account balances and any damages, incurred as of the date I notify the Operator of my termination.

Regardless of which party terminates, I will return all the Operator's property (such as keys, helmets, and/or access cards) and I will receive a refund of any funds due to me, less all outstanding account balances, damages, and losses chargeable by the Operator against me, which refund shall be made no later than sixty (60) days after I return all the Operator's property to the Operator.
